1. Disclosure to Law Enforcement: User agrees that Infinite-Realms may disclose all User information to any law enforcement agents without consent or notification to the User. In addition Infinite-Realms shall have the right to terminate all services of the User.

2. Service Rates: User acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to User. For  payment terms. For all other payment terms, the User will be charged for account add-ons for the full months remaining in the current payment term for site membership and subsequent payments are due on the next anniversary date of the payment term for site membership. User is aware that Infinite-Realms may prospectively change the specified rates and charges from time to time.

3. Payments and Fees: All payments are final and nonrefundable! Accounts are set up on a prepaid basis. Subsequent payments are due on the anniversary date of the payment term for that term's service. Client will be charged each payment term until a proper request for cancellation is received. 

4. Failure to Pay: Users are responsible to keep their e-mail address up to date with Infinite-Realms to avoid account cancellation if a problem should arise with the processing of payment.  If you desire to cancel your account, please follow the proper procedure to do this as outlined in this TOS. Such termination will not relieve User of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.

5. Account Cancellation: All account cancellation requests must be sent to owner@Infinite-Realms.com and include the following information:

A cancellation confirmation e-mail will be sent to the primary e-mail address on the account. User's account cancellation is not complete unless User receives a confirmation e-mail . 

6. Technical Support Boundaries: Infinite-Realms provides support related to issues of the server not functioning within acceptable established parameters. Infinite-Realms does not offer tech support for  specific issues and conflicts with chat program due to malicious code in Avatar codes or any other such issue.

7. Unsolicited Commercial E-mail (SPAM): Infinite-Realms takes a zero tolerance approach to the sending of Unsolicited Commercial E-mail or SPAM over our network. Very simply this means that Users of Infinite-Realms may not use or permit others to use our network to transact in SPAM in any way. Violations of this policy carry severe penalties, including termination of service.

a. Violation of Infinite-Realm's SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, Infinite-Realms will initiate an immediate investigation. During the investigation, Infinite-Realms may restrict Users access to the network to prevent further violations. If a User is found to be in violation of our SPAM policy, Infinite-Realms may, at its sole discretion, restrict, suspend or terminate User's account. Infinite-Realms reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. Infinite-Realms will notify law enforcement officials if the violation is believed to be a criminal offense.

b. A violation of this policy will result in an "Administrative Fee" of $150 and the User's account will be terminated. Users who violate this policy agree that in addition to these "Administrative" penalties, they will pay "Research Fees" not to exceed $175 per hour that Infinite-Realms personnel must spend to investigate the matter. Please do not SPAM from your account or even from an outside account that references our domain name.

8. Personal Account Security: Users are responsible for any misuse of their account. Users must take steps to ensure that others do not gain unauthorized access to their account. It is the responsibility of the User to keep his/her password secure. 

9. Third Party Accountability: Infinite-Realms Users will be held responsible and accountable for any activity by third parties, using their account, that violate Infinite-Realm's AUP and TOS. If a user violates any of Infinite-Realm's policies, the User's account will be cancelled permanently.

10. Network Usage

a. Data Transfer and Disk Space Usage: User agrees that disk usage shall not exceed the number of megabytes for the services ordered by User on the Order Form (the "Agreed Usage"). Infinite-Realms shall have the right to take corrective action if User's disk usage exceeds the agreed usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services. If Infinite-Realms takes any corrective action under this section, User shall not be entitled to a refund of any fees paid in advance prior to such action. In the event that User exceeds the included allocation, Infinite-Realms may, at its sole discretion, collect a deposit, in an amount determined by Infinite-Realms, against User.

b. System and Network Security: Violations of system security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Harassment of people on this site, either in the realm you chat or any other realm.

11. Suspension of Service or Cancellation: Infinite-Realms reserves the right to cancel service at any time for any reason. Any violation of policies which results in extra costs will be billed to the User. (i.e. transfer, space etc.) Prior notification to the User is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The User will not be credited for the time the User's account was suspended.

12. Indemnification: User agrees that it shall defend, indemnify, save, and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. User agrees to defend, indemnify, and hold us harmless against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with our services; (2) any material supplied by User's infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and .

13. Disclaimer: We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by the hosting company and its employees. We reserve the right to revise our policies at any time. User further acknowledges that the Infinite-Realm's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by User for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

14. Amendments: Infinite-Realms reserves the right to revise its policies and service(s) at anytime. If you do not agree with any revision to the Agreement or change in service(s), you may terminate this Agreement at any time by terminating your account following the proper cancellation procedure as outlined in this TOS. You agree that, by not terminating the account following any revision to this Agreement or change in service(s), you shall be bound by any such revisions and service changes. 

15. When you pay for the set-up of a room it is presumed you have read and understood the following Terms of Use for all rooms hosted by Infinite Realms.

On setting up a room with Infinite Realms you will receive:

16. Paying for the set-up of a new room does not give you ownership of that room. The space is leased to you for no specified period and this lease may be terminated at any time by the site administrator for any of following reasons but not limited to them:

17. If a room is paid for by 1 person but given to another as a gift to run. The one it is given to has the rights to operate it as they see fit. Paying for it does not give you any extra privileges over the room. Control of the room and how it is run is transferred to the controller of the room. At the same time if it is paid for by 1 person and intention is that they share in the room then there is a split up the RC of the room is required to pay the other back for the investment if they wish to continue on their own.

18. The above list is meant to give you examples of the sort of behavior that might lead to the loss of the room and the list is not an exhaustive one. The Infinite Realms Administrator has the final say in such matters. Infinite Realms does not implement site wide bans lightly, any permanent bans implemented on individuals who have been found to have behaved in an unreasonable way will be the result of a proper investigation by an impartial member of the site administration team. Their decision is final and there is no right of appeal.

19. The fee pays for the time it takes to create a room, code the PDs and do any additional links to the rest of the realm the room is based. In the event a room is taken away for whatever reason there will no refund of the set-up fee.

20. Controller of chat room on Infinite-Realms chat site (the Releasor), in consideration of Use of a chat room on IR, the receipt and sufficiency of which is acknowledged by the Releasor, hereby releases and forever discharges Infinite-Realms (Brent Running) (the Releasee), from all legal actions, causes of action, damages, claims and demands whatsoever, which the Releasor had, or now have or hereafter can, shall or may have for any reason whatsoever, including but not limited to all actions, causes of action, damages, claims and demands arising out of a minor using the room that I control. Furthermore the Releasor agrees responsibility of a minor being found to be playing in my room with my knowledge will be completely my own.

21. For the privilege of using said chat room, the Releasor further agrees not to make claim or take proceedings against the Releasee or any other person or
entity which may claim contribution or indemnity under the provisions of any statute or otherwise. 

22. The above terms of use may be changed at any time by the site administrator.
